By reserving your ferry transport with ferry operator Bluewater Express, you expressly acknowledge and agree that Bluewater.com.sg/Insites Net Design Pte Ltd acts solely as an intermediary platform, i.e. is not a transportation provider, and that, as such, Bluewater.com.sg/Insites Net Design Pte Ltd ("the Platform") and its owners disclaim all liability and accountability, whether financial, legal, or otherwise, for any incidents arising from or related to your ferry journey. Once your ferry booking is confirmed, the contract of carriage is strictly between you and Bluewater Express.

Specifically:

1. You use the website, Bluewater.com.sg, at your own risk.

2. This website is provided on as-is basis. The Platform does not warrant or represent that the content of this website is always accurate, always up-to-date or always complete, or that it does not infringe upon the rights of any third parties. The Platform makes no representations or warranties of any kind with respect to this site, its contents or any of the services provided by the site. To the maximum extent permitted by law, the Platform disclaims all implied representations and warranties including, without limitation, implied warranties that the services offered and provided by the website will be of merchantable quality, fit for any purpose or will comply with any descriptions on the site.

3. When using the Platform's website, information will be transmitted over a medium which, in many cases, is beyond the control or jurisdiction of the Platform. To the maximum extent permitted by law, the Platform (including the Platform's officers, employees, shareholders or other representatives) are not liable for any loss or damage (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption), however caused (including negligence), which may be directly or indirectly suffered, in connection with your use of or inability to access this website or the purchase and use of any services provided via this site. This limitation of liability (whether arising under contract, tort (including negligence) or statute) applies to all damages of any kind including compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property, personal injury, death and claims of third parties.

Access to and use of the Platform's website is subject to factors beyond the Platform's control. the Platform does not represent or warrant that the Platform's website, the server that makes it available, or any of the products or services provided through the Platform's website, will be free of errors, viruses or defects, or that the service will always be uninterrupted or timely. Because of the nature of the Internet, the Platform does not warrant that the Platform's website will be secure, and the Platform will not be liable for any disruptions to the Platform's website 5. In the event that the Platform's website fails to operate or causes any loss or damage, due to non-availability of information, the Platform cannot and will not be held responsible, nor accountable.

6. The Platform operates on the condition that travelers validate their booking at the ferry terminal and collect their boarding passes for the ferry seats booked. Travelers arriving at the terminal ticketing counter after the counter has closed, or after the ferry in question has departed, forfeit their ferry reservation. Travelers who do not come to the ticketing counter at all forfeit their ferry reservation. Travelers who decline the boarding passes from the ticketing counter staff forfeit their ferry reservation.

7. In the event a ferry departure is deemed unsafe to proceed, or is cancelled on account of the tide, or sea state, a squall, or for any other reason, the Platform cannot and will not be held responsible, nor accountable. Any and all refund requests are subject to approval by Bluewater Express.

8. The Platform cannot and will not be held responsible, nor accountable, for personal injury or death resulting from ferry fire, collision, sinking, or any other mishap, either as a result of an accident, or Bluewater Express mismanagement, or otherwise, either while at sea, or otherwise.

9. To the fullest extent permitted by law, remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.

10. These specific Terms and Conditions - both above and below - may be amended by the Platform as the Platform deems appropriate. Travelers shall be bound by the Terms and Conditions so amended.

Itinerary changes

Any and all itinerary amendment requests by passengers are subject to approval by Bluewater Express!

Ferry times

The ferry between Mersing and Tioman is subject to tidal ranges, sea state, weather etc. This also applies to Tanjung Gemok (also called Teluk Gading).

Ferry destinations

A round-trip ferry ticket represents one uninterrupted leg from either Mersing or Tanjung Gemok (Teluk Gading) to any one final destination in Tioman, and one uninterrupted leg from any one legitimate departure point in Tioman to either Mersing or Tanjung Gemok (Teluk Gading). That is, there will be a maximum of one single disembarkation per ferry leg. Once the passenger has disembarked, even if prematurely, i.e. at a ferry stop before the actual ferry stop intended and booked, that particular ferry leg shall be considered redeemed.

Cancellation/Refund Policy Ferry Tickets

All cancellation requests of confirmed bookings are subject to approval by Bluewater Express.

Email delivery failure

It is the passengers' responsibility to contact Bluewater Express in order to be informed of the ferry travel details. Ferry reservation confirmation emails, or any other messages, sent by Bluewater Express in response to the ferry booking by the traveler, that are not received by the intended recipient due to an incorrectly typed email address during the booking process, incorrectly set spam filter, full mail box, or any other email problem, resulting in passengers missing their ferry trip or ferry trips booked, will result in this/these particular booking(s) being redeemed. In other words, these bookings are forfeited. No refund will be given.

Luggage

Outsized luggage, including, but not limited to, oversized golf bags/equipment, surfboards, (foldable) bicycles, etc, are all subject to excess luggage fee. Excess luggage fee also applies when the number of luggage pieces per individual passenger is beyond Fair Use Policy. The final amount of excess luggage fee chargeable is determined by Bluewater Express. The Platform and its owners accept no responsibility for excess luggage fee incurred, or any consequences thereof.

Weather/Schedule/Updates

Notifications provided via the Platform's social media or messaging channels are a courtesy only and are not a substitute for direct verification with the ferry operator. As the Platform is dependent on third-party notifications, the Platform and its owners cannot and will not be held responsible for errors in said notifications. This applies to any and all the Platform's typos and/or errors and/or omissions in the Platform's Emails, Tweets ("X"), Facebook announcements, Whatsapp and all other media and communication modes used by the Platform. As information provided directly by the ferry operator takes precedence over any data or updates displayed by the Platform, you are strictly required to maintain direct contact with Bluewater Express for schedule verification. Failure to do so is at your own risk and expense.

Busonlineticket.com

The Platform is third-party affiliate/agent of Busonlineticket.com for ferry, bus/coach and train tickets. As such, by reserving your transport with the various ferry and/or bus/coach and/or train companies available on the Busonlineticket.com booking forms on any website page belonging to the Platform, you expressly acknowledge and agree that the Platform acts solely as an intermediary platform and is not a transportation provider. The Platform and its owners hereby disclaim all liability and accountability, whether financial, legal, or otherwise, for any incidents arising from or related to your ferry, bus or train journey. Once your Busonlineticket.com booking is confirmed, the contract of carriage is strictly between you and Busonlineticket.com.

Private Road Transport Provider

By using the private road transport provider ("Private Driver") referral services provided by the Platform, you expressly acknowledge and agree that the Platform acts solely as an intermediary platform and is not a transportation provider. The Platform and its owners hereby disclaim all liability and accountability, whether financial, legal, or otherwise, for any incidents arising from or related to your road journey. This total exclusion of responsibility includes, but is not limited to, vehicular accidents, personal injury, property damage, fire, criminal acts, or any mechanical failures occurring while you are a passenger. Furthermore, the Platform shall not be held responsible for service failures by the Private Driver, such as "no-shows," significant delays, or misconduct by the Private Driver. By proceeding with a referral or booking, you agree that any and all claims for damages or restitution must be directed exclusively to the Private Driver, and you hold the Platform and its owners entirely harmless from any mishaps, losses, or grievances incurred during your road trip.

Car Parking

By using the car parking information or referrals provided by the Platform, you expressly acknowledge and agree that the Platform acts solely as an informational intermediary and does not own, operate, or manage any parking facilities in Mersing, Tanjung Gemok (Teluk Gading), or surrounding areas. All parking is at the vehicle owner's sole risk. The Platform and its owners hereby disclaim all liability and accountability for any incidents occurring within or related to these parking areas, including but not limited to vehicular theft, break-ins, vandalism, accidental damage, or weather-related damage. Furthermore, the Platform does not guarantee the availability of parking spaces, nor the security protocols of independent parking operators. Any disputes or claims for damages must be directed exclusively to the respective parking lot owner/management.
